"Brand X Internet Services v. FCC"

This case prompted the formation of NIA, which supports the plaintiff (and NIA member), Brand-X Internet Services. If the Supreme Court refuses to hear the case on appeal, or decides in Brand-X's favor, all US ISPs and consumers stand to share in the promise of true consumer choice for high speed internet service. While the case only addresses cable modem internet service, the ultimate ruling will likely impact other broadband delivery platforms--we hope by opening them to competition as promised under the Telecom Act of 1996.
